1. The Yoga4Man Digital Download SERVICE
The YOGA 4 MAN (VICKI FORMAN) Download Service offers downloads of digitized versions of our Video and DVD content and information relating to such services, and other content (individually and collectively, “Digital Content”) and other services under the terms and conditions in the Terms of Use. The YOGA 4 MAN (VICKI FORMAN) Download Service allows you to access and download Digital Content from our YOGA4MAN.com & YOGAFORMANKIND.com Download websites.
2. Digital Content
2.1 Rights Granted. Upon your payment of our fees for Digital Content, we grant you a non-exclusive, non-transferable, non-sub license-able, limited right and license to download, and to retain a permanent downloaded copy to use the Digital Content for your personal, non-commercial, entertainment use, and private use only subject to and in accordance with the Terms of Use. You may copy, store, transfer and burn the Digital Content only for your personal, non-commercial, entertainment use, subject to and in accordance with the Terms of Use.
2.2 Restrictions. 2.3 Explicit Content. You agree that we have no liability to you for Digital Content you find to be offensive, indecent or objectionable.
2.4 All Sales Final; Downloading and Risk of Loss; Availability of Digital Content. All sales of Digital Content are final at time of purchase. We do not accept returns of Digital Content. Each purchase of a Permanent Download shall be deemed a final, nonrefundable sale. Prices for Permanent Downloads are subject to change without notice. You are responsible for making sure your PC or other portable devices can receive and play our Downloads. YOGA 4 MAN (Vicki Forman) Downloads is not responsible for transmission problems affecting your ability to download our files. Once you have purchased Digital Content, we encourage you to download it promptly and to make back-up copies of it. If you are unable to complete a download after having reviewed our online Download FAQ’s help section, please contact YOGA 4 MAN Download customer service. You bear all risk of loss after purchase and for any loss of Digital Content you have downloaded, including any loss due to a computer or hard drive crash. We may, from time to time, remove Digital Content from the Service without notice. 2.8 Represent of Use. In consideration of Your use of the YOGA 4 MAN Downloads Service, You represent that You are of legal age to form a binding contract and are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction. 2.9 Content Availability. Yoga4man.com & Yogaformankind.com may, from time to time, remove Permanent Downloads from the Yoga4Man (Vicki Forman) Download Service. If you plan to download Digital Content that you purchase, we encourage you to do so promptly after your purchase. If you are unable to complete a download after having reviewed our online Download FAQ’s help section, please contact customer service at info@yoga4man.com. Once you purchase Digital Content and we make the Digital Content available to you, you have the responsibility for completing the download. You assume all risk of loss of the Digital Content after downloading. In the event user loses a download from their computer they may re-download the purchased file, as long as it is still available, for a maximum of TWO (2) times including the original purchase.
2.10 File Transfer & File Sharing. You must not allow copying of Yoga4Man (Vicki Forman) DOWNLOAD including, but not limited to, copying through file sharing networks. Do not re-transmit via email. Multiple use at the same address is allowed.
3. No Reverse Engineering, De-compilation, or Dis-assembly
You may not, and you will not encourage, assist or authorize any other person to, modify, reverse engineer, de-compile or disassemble, or otherwise tamper with, the Digital Content or the Unique Identifiers, whether in whole or in part, or create any derivative works from or of the Digital Content.
4. Reservation of Rights

5. General
Termination: Amendments. If you violate any of the terms or conditions of this Agreement, your license to Purchased Digital Content will immediately terminate, and Yoga4man.com & Yogaformankind.com may, in its discretion, may immediately revoke your access to the Service without notice to you and without refund of any fees. In such event, you must delete all copies of Digital Content that you have downloaded, and Yoga4man.com & Yogaformankind.com shall have the right, without notice to you, to automatically discontinue your access to Digital Content from the Service. Yoga4man.com & Yogaformankind.com reserves the right to suspend, or discontinue the Yoga4Man (Vicki Forman) Download Service, or any part thereof, at any time so long as a 90 day notice is given on the Yoga4Man (Vicki Forman) Download website, and Yoga4man.com & Yogaformankind.com will not be liable to you should it exercise such rights, even if your use of Digital Content is impacted by this action. Our failure to insist upon or enforce your strict compliance with the Terms of Use will not constitute a waiver of any of our rights. 8. Terms of Sale
This Terms of Sale will be governed by and construed in accordance with the laws of the State of California and the Unites States of America, without giving effect to the conflict of law’s provisions of California, or Your actual state, or country of residence. 9. Limitation of Liability

YOGA4MAN.COM & YOGAFORMANKIND.COM WILL NOT BE LIABLE FOR ANY INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES OR ANY KIND ARISING FROM THE USE OF THE DOWNLOAD SERVICE OR FROM PERMANENT DOWNLOADS, INFORMATION, MATERIALS OR PRODUCTS INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICE, OR FOR ANY DAMAGES IN EXCESS OF THE AMOUNT PAID FOR THE SPECIFIC PERMANENT DOWNLOAD GIVING RISE TO THE APPLICABLE CLAIM FOR DAMAGES.
YOGA4MAN.COM & YOGAFORMANKIND.COM SHALL USE REASONABLE EFFORTS TO PROTECT PERSONAL INFORMATION SUBMITTED BY YOU IN CONNECTION WITH THE SERVICE, BUT YOU ACKNOWLEDGE AND AGREE THAT YOUR SUBMISSION OF ANY INFORMATION IS AT YOUR SOLE RISK, AND TO THE MAXIMUM AMOUNT PERMITTED BY LAW, YOGA4MAN.COM & YOGAFORMANKIND.COM HEREBY DISCLAIMS ANY AND ALL LIABILITY TO YOU FOR ANY LOSS OR LIABILITY RELATING TO SUCH INFORMATION IN ANY WAY.
ACKNOWLEDGMENT AND ACCEPTANCE OF THE TERMS BY PURCHASING A YOGA 4 MAN (VICKI FORMAN) DOWNLOAD, YOU ACKNOWLEDGE THAT YOU HAVE READ AND REVIEWED THIS AGREEMENT IN ITS ENTIRETY AND AGREE TO ALL ITS TERMS AND CONDITIONS.
